What is a power of sale?
When a borrower defaults on a mortgage in Ontario, the mortgage usually allows the lender to sell the property to recover the debt. The lender signs the agreement of purchase and sale, not the owner.
- 02
Is it cheaper?
Not automatically. The lender has a legal duty to try for fair market value and answers to the borrower for the result, so most are priced close to market. The opportunity is usually in condition or timing, not in the asking price.
- 03
What changes in the contract?
The home is sold as is, where is. The lender has typically never lived there, so it gives no representations or warranties about the property. Expect a lender's schedule of clauses that is rarely negotiable, and appliances or other chattels may not be included.
- 04
Can the sale be cancelled?
Most lender schedules let the lender end the agreement if the borrower pays out the mortgage before closing. If that happens your deposit is returned, but the home is not yours.
- 05
How do you protect yourself?
Inspect before you offer, or make the offer conditional on inspection. Have your lawyer read the lender's schedule before you sign. Confirm with your own lender that it will finance a property sold as is.
